Sale of Gift Cards

  1. Sales of Digital Gift Cards (“Gift Cards”) made via this website (“The Website”) is managed by Diggecard UK Ltd (“Diggecard UK”) at 5 High Barn, Warren House Road, Ashridgewood Business Park, Wokingham, Berkshire, RG40 5BS registered in England and Wales with Company No. 11448044.
  2. Payment can be made via VISA or Mastercard debit or credit card.
  3. Each transaction is subject to various fraud checks and Diggecard UK reserves the right to refuse an order if the payment is subject to additional verification or scrutiny or for any other reason, without providing explanation.
  4. Gift Cards ordered though The Website will be sent to the email address or mobile phone number stated in the individual order. Despatch will usually be immediate but could be up to 48 hours after receipt of payment.
  5. By placing an order, you consent to its immediate supply, the supply being digital content your 14-day withdrawal period applies only if funds have not been spent within the 14-day period.
  6. By placing an order, you are confirming all the data provided is correct. In some cases, it is not possible to rectify errors after the order has been placed, so any mistakes should be corrected before you submit the order.
  7. Where possible, Diggecard UK will try to meet all delivery requirements, but Diggecard UK shall not be liable for any loss incurred either directly or indirectly by failure to meet the requested delivery date. ‘Loss’ in this instance includes any loss of profit, costs, damages, charges, other expenses, consequential losses and non-financial losses.
  8. Risk will pass to the customer upon delivery, and title will pass upon receipt of payment in full. Diggecard UK has no liability for lost, stolen or damaged Digital Gift Cards once risk has passed to the customer at the time of delivery.
  9. Refunds will not be given on the purchase of a Digital Gift Card. Once your payment has been received, your order can only be cancelled by contacting the retailer who has issued the gift card.
  10. Diggecard UK is not directly linked to any retailer, and Diggecard UK cannot take responsibility for products and services offered by the retailers listed on the website. In addition, the retailers shall not be responsible for services offered by Diggecard UK and its associated companies.
  11. The collection and management of your credit card data and personal information, which is collected, processed and managed, is solely used to authorise payment and is not held by Diggecard UK.
  12. Digital Gift Card quantities should be checked immediately upon receipt. Any discrepancies must be notified immediately to Diggecard UK Customer Support by emailing support.uk@diggecard.com. Diggecard UK cannot be held responsible for any shortage or loss of any Digital Gift Cards not notified to Diggecard within seven working days of delivery or the specified delivery date in respect of lost cards.
  13. Payment is taken at the time of purchase of the Digital Gift Card. Cleared payment is required prior to the despatch of orders. Your credit/debit card statement will read “Diggec* RETAILER NAME”.
  14. Diggecard UK cannot be held responsible for failure to meet its service obligations when any failure is brought about due to a cause totally beyond its reasonable control, for example: acts of God, trade disputes; governmental intervention, fire, flood, and disruption to computer and IT infrastructure.
  15. Breach of these terms and conditions by you will entitle Diggecard UK to seek the appropriate legal remedy available for injunction, damages or otherwise.
  16. Whilst the contents of The Website are checked for accuracy, Diggecard UK cannot be held responsible for omissions or errors or any statements made on the site. Nor is Diggecard UK responsible for any losses incurred if information is used from the website or if accessing the site results in viruses being downloaded to your computer equipment.
  17. The images on the website, including trademarks, can only be used with the permission of the owner.
  18. As a UK-registered company, any disputes with Diggecard UK will be subject to resolution under English Law and subject to the exclusive jurisdiction of the courts of England and Wales.
  19. Digital Gift Cards should be handled like cash. Diggecard UK is not responsible for lost or stolen Digital Gift Cards.
  20. Diggecard UK reserves the right to amend these terms and conditions from time to time where it considers it reasonable and necessary to do so.
  21. The laws of England and Wales govern these terms. The courts of England and Wales will have non-exclusive jurisdiction in connection with any disputes or claims.
  22. Gift Cards are issued by and remain the property of the individual retailer.
